Terms of Service

These Terms and Conditions (“Terms”) govern your access to and use of the MelodyAI web application (the “Service”) operated by Zakti Inc., a Delaware corporation (“Zakti”, “we”, “us”, or “our”). By accessing or using MelodyAI, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using MelodyAI, you confirm that you meet this requirement. If you are under 18, you must have your parent or legal guardian’s consent.

2. Account Access

MelodyAI requires OTP-based login via email. You are responsible for maintaining the confidentiality of your device and access credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or disrupt service operations.

3. Use of the Service

MelodyAI provides a voice-native AI companion experience. You initiate weekly or real-time AI voice interactions, and the system generates spoken responses based on your input. You agree to use the Service in accordance with applicable laws and not to misuse the Service for any unlawful, harmful, or abusive activity.

4. Data Collection and Privacy

By using the Service, you consent to our collection and use of personal data, which includes:

  • Voice data and audio inputs
  • Email, name, and device metadata
  • Usage analytics and session logs

Your data is used solely to operate and improve the Service. We do not sell your data. Data may be processed by third-party services such as OpenAI, ElevenLabs, and AWS. See our Privacy Policy for more details.

5. Subscriptions and Payments

MelodyAI offers monthly and annual subscription plans. By subscribing, you agree to:

  • Pay recurring charges based on your selected plan.
  • Authorize your payment method to be charged at each renewal.
  • Cancel anytime before your next billing cycle to avoid auto-renewal.

Refunds are not guaranteed and are issued at our sole discretion. All payment processing is handled by third-party platforms. We do not store your credit card or billing information.

6. Intellectual Property

All content, branding, and software within MelodyAI, including audio, interface, and AI-generated responses, are owned by Zakti Inc. or licensed from partners. You may not copy, modify, or distribute any part of the Service without our express permission.

7. Acceptable Use Policy

You agree not to:

  • Use the Service for any illegal or harmful purpose.
  • Harass, impersonate, or threaten others via voice interactions.
  • Probe or scan the system for vulnerabilities.
  • Attempt to reverse-engineer any part of the AI system.

8. Third-Party Services

MelodyAI integrates with:

  • OpenAI (for language models)
  • ElevenLabs (for voice synthesis)
  • Amazon Web Services (for infrastructure)
  • Vercel.com (for infrastructure)

These services may process your data in real time. Use of MelodyAI implies acceptance of their respective terms and privacy practices. We are not liable for data processed by these providers.

9. AI Disclaimer

MelodyAI provides automated AI-generated responses based on your input. It is not a substitute for professional advice—legal, medical, emotional, or otherwise. You understand that:

  • AI may generate inaccurate or inappropriate content.
  • AI output may vary in tone, quality, or coherence.
  • Real-time interactions are not guaranteed to be error-free.

You use the AI features at your own discretion and risk.

10. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available.” We do not guarantee uninterrupted service, response accuracy, or compatibility with all devices. To the fullest extent permitted by law, Zakti Inc. disclaims all warranties and shall not be liable for:

  • Any indirect or consequential damages
  • Loss of data, profit, or reputation
  • Errors, omissions, or delays in the Service

11. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may stop using the Service at any time. Upon termination, your right to access the Service ends immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

13. Modifications

We reserve the right to update or modify these Terms at any time. Changes will be posted with a new “Effective Date.” Continued use of the Service after any changes indicates your acceptance.
